Consumer Guarantees Act 1993: In any case of conflict, the provisions of the Consumer Guarantees Act 1993 will apply. The Learner Ltd will do everything reasonable in their power to satisfy the customer.
Product and software: All products including electronics and software sold are subject to the terms and conditions of the license agreement of that product. All software is warranted in accordance with the license agreement that governs its use. The Customer acknowledges their obligations to abide by such license agreements. The Customer acknowledges that The LEARNER Ltd does not warrant any software under these Terms and Conditions.
Ordering: The customer may order products by completing and submitting the checkout process on the website. The customer must provide all required information (including name, email address, and payment details) for delivery purposes otherwise The Learner Ltd may not be able to process the order.
The Learner Ltd reserves the right to cancel orders that we believe to be fraudulent or constitute a mis-use or a promotional or marketing activity or where an error has occurred including but not limited to errors relating to pricing.
If a product is found to be wrongly-addressed by The Leaner then The Learner will be responsible for the re-delivery, replacement or refunding of the product. If the Customer is found to have given an incorrect or insufficient address, then The LEARNER will not refund or resend the product and all responsibility for correcting delivery will be that of the Customer.
If the Customer credits money to an incorrect bank account number, and the correct number was provided to the Customer by The LEARNER, then the Learner will not accept any responsibility for correcting payment and the goods will not be dispatched.
The Learner does not recommend that cash be mailed for payment of products. If the Customer does mail cash, The Learner accepts no responsibility for the theft, loss or otherwise non-delivery of mailed cash.
Refunds will be given at the discretion of the Learner Ltd Directors once due processes have been followed.
Prices - Except where specifically stated in relation to a particular product, the price for the products are stated and are payable in New Zealand dollars (NZD). Any currency conversion will take place online at the rate applicable at the time of purchase.
Taxes and other charges -All prices and delivery charges within New Zealand are inclusive of New Zealand Goods and Services Tax at the rate of 15%.
SHIPPING AND DELIVERY -Orders will be dispatched on receipt of payment
If your order ships to a delivery address outside New Zealand, no GST will be charged.
New Zealand Orders: Delivery within NZ will be by courier or post. A charge of NZ$6.00 (Inc. GST) for freight will be added to your order in the South Island - North Island - A freight discount is available for members
Gift Vouchers: Gift vouchers will not be exchanged and are not subject to returns for credit or refunds. Gift vouchers are valid for one year from their date of issue, thereafter the voucher expires. Any remaining credit is non-refundable.
Copyright & Trademarks: All content on the site remains the property of The Learner Ltd as defined by New Zealand and International Intellectual Property Laws, including but not limited to Copyright and Trademark laws. You agree not to modify or alter the content in any way, or make it available to any third parties.
Availability and Cancellation; All orders are subject to the availability of products. If for any reason a product is not available, the Learner Ltd will endeavour to notify the non-availability on this website. In order to provide the greatest range of products, you understand that the LEARNER does not stock all products listed on this site in a single warehouse. Product availability information is provided by a number of suppliers. The Learner works with these suppliers to ensure the best possible availability.
Rewards can only be used as discounts on future orders and cannot be converted into a cash payment from the Learner to the Customer or be used to purchase gift vouchers.
Delivery: The Learner will make every effort practical to ensure that delivery timeframes given are accurate. However the delivery times stated for products on this site assume that the stock availability information provided by our suppliers is accurate and that delivery times are not adversely affected by unforeseen events. By placing an order, you agree not to hold The Learner liable for any loss or damage directly or indirectly arising out of or in connection with any delay or failure to deliver within the estimated time frame.
Any quotations of delivery times by The Learner Ltd are made in good faith but are estimates and the Learner Ltd shall not be bound by such quotation and will not be held liable for any loss, expense, or other damage caused by any delay in delivery.
New Zealand law requires all international packages to have attached customs documentation, which describes the goods being sent and their cost.
Shortages, Damages or Loss in Transit: Liability for shortages in the quantity of goods delivered is limited to making up the shortages. Where the customer believes that there is a shortage in the quantity of products delivered, the customer must notify the Learner of any such claim within 7 days of delivery and must provide the Learner with a reasonable opportunity to investigate that claim.
All orders delivered within New Zealand are insured against damage or loss during transit. The Learner will not accept any liability for loss or damage in transit that exceeds the value of the loss or damage insurance applying to that delivery.
Goods leaving the Learners’ premises are adequately packed. Claims for damage or loss in transit must be made against the carrier in the appropriate prescribed manner:
Return of Goods for Credit or Refund: Goods supplied in accordance with the customer’s order can only be returned with the express approval of the Learner Directors.
Limitation of Liability: The Customer shall indemnify The Learner Ltd against any loss of or damage to property or for data or software which is lost, corrupted, deleted or altered. The Learner shall not be liable to the Customer for any incidental, indirect, special or consequential damages arising out of or in connection with the purchase, use or performance of products or services, even if The Learner Ltd has been advised of their possibility. In no case shall the maximum liability exceed the cost of the original order.
Risk: Once the customer’s order has been delivered to the customer (or has otherwise been delivered in accordance with the customers delivery instructions), the customer assumes full responsibility for and risk in the products.
Changes to these Conditions of Use: The Learner reserves the right to change these Terms and Conditions from time to time by publishing the changed terms on the website.
